1Who we are and what these Terms cover#

These Terms of Service ("Terms") govern your use of VideoTour.ai, the website and web app operated by VideoTour AI LLC, with offices at 66 W Flagler St Suite 900 PMB 11010, Miami, FL 33130, USA ("we", "us").

By creating an account, subscribing or buying AI credits, you agree to these Terms. If you use VideoTour.ai for a company, you confirm that you may accept them on its behalf.

2The service#

VideoTour.ai turns property photos into video tours, reels and other marketing content using artificial intelligence, through a web interface. Access starts as soon as your payment is confirmed. There is no physical delivery.

We rely on third-party providers for payments (Stripe), hosting and AI generation. We may add, change or remove features over time. We aim to keep the service available, but we do not guarantee that it will be uninterrupted.

3Your account and your team#

Keep your account details accurate and your password private. You are responsible for the activity on your account.

On plans with several users, the account owner manages the subscription and is responsible for the members they invite. The number of users each plan includes is shown on the pricing page.

Do not share one account between people outside your team, or open several accounts to repeat a free offer.

4Free video, plans and allowances#

You can try VideoTour.ai with a free video before subscribing, without a payment card.

Paid plans are billed monthly or annually. The videos, AI credits and users each plan includes are those shown on the pricing page when you subscribe.

5Prices, payment and taxes#

Prices are in US dollars (USD). Taxes are added at checkout where they apply.

Payments are processed by Stripe, by card or another payment method Stripe offers at checkout. We do not store your full card details.

Promotion codes apply under their own conditions. A discount on your subscription carries over when you change plan.

Fraudulent payment attempts lead to immediate cancellation, without notice or refund.

6Renewal and cancellation#

Subscriptions renew automatically at the end of each billing period until you cancel.

You can cancel at any time from your profile, with Change or cancel my subscription, which opens your billing page. Cancellation takes effect at the end of the period you have paid for, and you keep your plan until then. You can renew before that date to keep it.

Annual plans are paid for the full year in advance. Cancelling stops the next renewal. The remaining months are not refunded.

7Changing your plan#

You can change plan from the pricing page in the app. Before you confirm, we show what you will pay and what you will receive.

• Upgrading applies immediately and starts a new billing period that day. You choose to pay either the difference, where the unused part of your current plan is deducted and you receive the difference in videos and AI credits, or the full price of the new plan, where nothing is deducted and its full allowance is added to what you already have.
• Downgrading, or moving from an annual to a monthly plan, takes effect at the end of your current paid period. Nothing is charged or credited when you ask for it, and you can cancel the scheduled change before it starts.
• No plan change results in a refund or an account credit for unused time.

8Videos and AI credits#

• Videos are an allowance per billing period. Unused videos do not carry over to the next period. Annual plans receive the year's videos at the start of the year.
• AI credits add up from one period to the next and do not expire. They have no cash value and cannot be transferred or exchanged for money.
• If a generation fails for technical reasons, its AI credits return to your balance automatically.
• Credit packs are one-time purchases of AI credits.
• When a subscription ends, your account returns to the free plan and remaining videos are removed. Your AI credits are kept.

9Failed payments#

If a subscription payment fails, Stripe tries it again and may email you. After a second failed attempt, your account moves to the free plan: remaining videos are removed and your AI credits are kept. When a later payment succeeds, your plan and its allowance come back.

10Refunds#

Payments for subscriptions and credit packs are not refundable once made, including for a completed video you are not satisfied with.

We refund billing errors, such as a duplicate charge, and proven technical failures attributable to VideoTour AI LLC. To ask for one, write to contact@videotour.ai with your account email and the charge concerned.

AI credits returned after a failed generation are an adjustment to your balance, not a refund.

11Your content#

You keep ownership of the photos, logos, music, voice recordings and other material you upload ("your content"). You allow us to store, process and transmit it, including to our AI providers, only as needed to provide the service to you.

You must own your content or have permission to use it. Cloning a voice or creating an avatar requires the consent of the person whose voice or image it is.

You are responsible for the accuracy of the property details you provide.

12Your videos and what you publish#

Completed videos are yours to use for any lawful purpose, including listing marketing and client work. Creating a video does not give you rights to someone else's material.

AI can make mistakes. Review every video before you publish it.

Some platforms, MLSs and local rules require you to disclose AI-edited or virtually staged images. You are responsible for following the rules that apply where you publish. A video made with VideoTour.ai is not automatically compliant with them.

Pages you publish through VideoTour.ai, such as video landing pages, can be seen by anyone with the link until you remove them.

13Acceptable use#

You agree not to use VideoTour.ai to:

• create content that is unlawful, misleading, discriminatory (including under fair housing laws) or that infringes anyone's rights;
• impersonate someone, or use a person's voice or image without their consent;
• copy, scrape, reverse-engineer or overload the service, or get around its usage limits;
• resell access to the service without our written agreement.

14Suspension and closing your account#

We may suspend or close an account that breaks these Terms, involves fraud or abuse, or puts other users or the service at risk. Where we can, we tell you why.

You can delete your account at any time from your profile. What happens to your data is described in the Privacy Policy.

15Disclaimers and limits of liability#

VideoTour.ai is provided "as is". We make no promise about views, engagement, leads or sales, which depend on factors outside our control, such as platform algorithms and audiences.

To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits or data, and our total liability for any claim is limited to the amount you paid us in the 12 months before it.

You agree to cover us against claims caused by your content, or by your use of the service in breach of these Terms.

Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded.

16Privacy#

We collect and use personal data, such as your name, email and payment information, to run the service and bill you, in line with the Privacy Policy and applicable data protection laws, including the GDPR where it applies. We share it only with the providers who help us run the service, or when the law requires it.

17Governing law and disputes#

These Terms are governed by the laws of the United States. In case of dispute, parties agree to seek amicable resolution before resorting to the competent courts.

18Changes to these Terms#

We may update these Terms from time to time. The date at the top of this page shows when they last changed. Continuing to use VideoTour.ai after a change means you accept the updated Terms.
